권리의 내용과 범위에 관하여는, 품종보호권과 특허권 모두 보호대상이 되는 품종이나 발명을 실시할 권리를 독점한다는 의미에서는 비슷하지만, 실시의 개념이나 효력범위에 서는 차이가 있다. 예를 들면, 식물신품종보호법에서는 농민의 자가채종에 대해서는 품종 보호권을 제한할 수 있는 근거조항을 두고 있으며, 다른 품종을 육성하기 위한 보호품종 의 실시, 즉 육종가의 예외에 관한 규정을 두고 있지만, 특허법에서는 연구 또는 시험을 하기 위한 경우가 아니라면 농민이 자가채종을 하거나 육종가가 다른 품종을 육성하기 위해 실시하는 경우에도 특허권의 침해에 해당하게 된다.
